By using ToGo UAE, you agree to these Terms. Please read them carefully before using our services.

1. About ToGo UAE

ToGo UAE is a technology platform that connects vehicle owners with independent automotive service providers and agents ("Service Agents"). ToGo UAE operates as a marketplace and intermediary platform only. ToGo UAE is NOT an automotive garage, towing company, or vehicle repair business. We do not directly employ Service Agents or perform any automotive services ourselves.

2. Platform Role and Liability

ToGo UAE is a technology intermediary. All Service Agents are independent contractors, not employees of ToGo UAE. Service Agents are solely responsible for the quality and safety of their services, holding a valid UAE driving licence, maintaining their own insurance, any accidents or incidents while performing services, and all traffic violations or fines incurred during service delivery.

3. Vehicle Insurance

You acknowledge that your vehicle should be covered by a valid UAE motor insurance policy. In the event of any accident, damage, or loss, your own motor insurance policy is the primary source of cover. ToGo UAE does not provide and does not promise any vehicle damage insurance, and is not an insurer. Any cover beyond your own policy is solely a matter between you, your insurer, and the responsible party.

4. Accidents and Incidents

In the event of an accident, collision, damage, or incident while a Service Agent is handling a Customer vehicle, fault is determined by the official police report. Where a Service Agent is established to be at fault, liability rests with the Service Agent and/or their insurance provider. Where the Service Agent is not at fault, the Customer’s own motor insurance policy applies. ToGo UAE accepts no liability for any damage, loss, injury, or harm arising from services performed by Service Agents. ToGo UAE’s maximum liability in any circumstance is limited to the service fee paid for the specific booking in question.

5. Reporting an Incident

Any accident, damage, or incident must be reported to ToGo UAE within 24 hours of the time it occurred, with as much detail as possible, by emailing admin@togouae.com or via WhatsApp on +971 56 699 0072. ToGo UAE may decline to review any complaint reported more than 24 hours after the incident occurred.

6. Traffic Fines and Violations

Any traffic fines, Salik toll charges, parking violations, or other penalties incurred by a Service Agent while handling a Customer vehicle are the sole responsibility of the Service Agent. ToGo UAE accepts no liability for such charges. Disputes regarding any such charge must be raised within 24 hours of the charge being notified.

7. Payments and Fees

A pickup fee is charged at the time of Booking and is communicated to you before payment is required. Additional charges may apply for towing, spare parts, and labour. These will be communicated and approved by you before any work exceeding a standard service is carried out. All payments are processed securely through Stripe. Pickup fees are non-refundable once a Service Agent has been dispatched.

8. Vehicle Handover and Custody

When handing over a vehicle to a Service Agent, the Customer authorises the Service Agent to drive, move, tow, or handle the vehicle for the purpose of the requested service only. A visual inspection of the vehicle’s condition will be documented, where reasonably possible with photographs, at both collection and return. The Customer is responsible for disclosing any known issues or damage before pickup and for removing all personal belongings and valuables from the vehicle. ToGo UAE is not responsible for pre-existing damage, mechanical or electrical failures, or for any personal belongings left in the vehicle.

9. Customer Responsibilities

Customers agree to provide accurate information when making a Booking, ensure their vehicle details and location are correct, confirm they are the registered owner or are authorised to arrange service for the vehicle, pay all applicable service fees through the Platform, and not engage Service Agents outside the Platform to circumvent fees.

10. Prohibited Conduct

Users must not use the Platform for any illegal purpose, provide false or misleading information, harass or threaten Service Agents or ToGo UAE staff, attempt to circumvent the Platform to deal directly with Service Agents, or reverse engineer any part of the Platform.

11. Limitation of Liability

To the fullest extent permitted by law, ToGo UAE shall not be liable for any indirect, incidental, special, or consequential damages, loss of profits or data, personal injury or property damage caused by Service Agents, or any damages exceeding the amount paid for the specific Booking in question.

12. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
